OFFICIAL RULES OF THE RAFFLE


By purchasing charitable raffle tickets, you agree to be bound by these Official Rules of the Raffle (the “Official Rules”) and by the decisions of the Boston Bruins Foundation, which shall be binding and final as to all matters related to the raffle. By purchasing a raffle ticket(s), you agree to be contractually bound by the terms and conditions of these Official Rules.


SPONSOR


The Boston Bruins Foundation is a 501(c)(3) non-profit corporation having a business address at 100 Legends Way, Boston, MA 02114. The Boston Bruins Foundation is the Sponsor of the raffle(s) (hereinafter referred to as the “Sponsor”).


NET PROCEEDS


All net proceeds of all charitable raffles will benefit the Sponsor, a designated 501(c)(3) non-profit corporation, and their charitable partners, also designated 501(c)(3) non-profit organizations. The net proceeds from all raffles will be dedicated to the Sponsor’s charitable purposes and the charitable purposes of the Sponsor’s charitable partners.


AGE & ELIGIBILITY


Raffle tickets may be purchased only by persons 18 years or older, or the minimum legal age for charitable gaming in your state or provinces, if older, in accordance with these Official Rules. Raffle tickets may not be purchased by anyone under the age of 18, regardless of location. You may not purchase raffle tickets if you are an employee of the Sponsor or an immediate family member of an employee of the Sponsor. Tickets are available for purchase on this website through a third-party payment processor during the drawing period dates and times as the same are posted on the specific raffle’s home page. Eligible states of participation include Alaska, Arizona, Colorado, Connecticut, Delaware, Florida, Georgia, Idaho, Illinois, Iowa, Kansas, Kentucky, Louisiana, Maine, Massachusetts, Missouri, Montana, New Hampshire, North Carolina, Ohio, Rhode Island, South Carolina, Vermont and Virginia.


PRIZES – INDIVIDUAL RAFFLES


The prizes for each individual raffle are fully described on that raffle’s home page on the website. Sponsor reserves the right to change the prize for a particular raffle in its sole discretion. When you purchase raffle tickets on a particular raffle page, you are only purchasing raffle tickets for that individual raffle and not for any other raffles being hosted on the website at that time. To purchase additional raffle tickets for other raffles, you must visit each individual raffle’s home page and process your payment separately for each raffle in which you wish to participate. Purchasing a raffle ticket does not guarantee that you will win a prize.


PURCHASING RAFFLE ENTRIES


The price of raffle tickets is $10.00 for five (5) raffle tickets, $20.00 for twenty (20) raffle tickets, $40.00 for eighty (80) raffle tickets and $100.00 for three hundred (300) raffle tickets.


RAFFLE TICKETS ARE NONDEDUCTIBLE


No portion of your raffle ticket purchase may be deducted as a charitable contribution for state or federal income tax purposes.


NUMBER OF RAFFLE TICKETS; ODDS OF WINNING


Unless otherwise specified, there is no minimum number of tickets that must be sold for the raffle to proceed, and there will be no capped maximum number of tickets sold. However, the Sponsor retains the right, in its sole discretion, to cancel or extend the time period for any raffle due to insufficient ticket sales. In the event of a cancellation of a raffle, you will be refunded the full purchase price for your tickets, without any deductions, within 30 days from the time the raffle was cancelled. The odds of winning a raffle will depend on the total number of valid tickets sold.


NO TRANSFER OF RAFFLE TICKETS; GIFTING


Raffle tickets are personal to the individual who purchases them and may not be given, assigned, resold or otherwise transferred to anyone. All raffle tickets which have been given away, assigned, resold or otherwise transferred in violation of these Official Rules, unless purchased through the website’s gifting module, shall be void. All individuals who transfer raffle tickets in violation of these Official Rules shall be ineligible to participate in the raffle or to win a prize.


However, should you win a raffle, you may be eligible to transfer your raffle prize, which the Sponsor retains the right, in its sole discretion, to approve or deny based on the circumstances. All raffle prize transfers must be approved of in advance by the Sponsor and the winner.


DRAWING


A winner will be selected in a random drawing using a random number generator algorithm. The Sponsor shall contact raffle winners by phone and/or email to notify the winners that they have won a prize. The winning raffle ticket number and the winner’s name will be posted on the website and will remain posted on the website for an indefinite period of time to be determined by the Sponsor, at its sole discretion, on the “Past Winners” page. If you believe that you possess a winning raffle ticket and have not been contacted by the Sponsor, you may inquire about whether you have won a raffle by sending an email to jtrombetta@bostonbruins.com. If prize winners cannot be contacted after reasonable efforts to do so by the Sponsor, or if prize winners forfeit their prizes, the prizes will be retained by the Sponsor for charitable use or awarded to other raffle participants, as the Sponsor may determine, in its sole discretion.


DETERMINATION OF OFFICIAL WINNER


Sponsor shall have the sole discretion to determine whether the winner is an official winner of a prize (the “Official Winner”). Sponsor’s decision concerning the identity of the Official Winner shall be final and binding. To become an Official Winner: (1) a winner must be eligible to participate in the raffle under these Official Rules and must not be in violation of these Official Rules as determined in Sponsor’s sole judgment; (2) the winner’s winning entry must be verified by Sponsor; (3) the winner must execute and return to Sponsor an affidavit of eligibility on a form to be provided by Sponsor before the prize is awarded; and (4) the winner must provide Sponsor with all tax identification information required by federal, state or local law prior to the winner’s receipt of the prize. If for any reason whatsoever all the foregoing requirements are not satisfied, or if Sponsor is unable for any reason to identify the holder of a winning raffle ticket or to contact the winner, then the winner’s prize will be deemed forfeited and the prize will be retained by Sponsor for charitable use or awarded to another raffle participant, in Sponsor’s sole discretion.


Sponsor shall use the following rules to determine the identity of the Official Winner of the prize: (1) Sponsor shall conclusively presume that the person who is in possession of the winning raffle ticket, by virtue of an email confirmation containing the winning number, is the lawful owner of that ticket’s winning number, and Sponsor shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which that person came into possession of such winning raffle ticket number email confirmation. In the unlikely event that an error or problem in the administration of the raffle results in two (2) or more raffle ticket purchasers holding winning raffle tickets that contain identical ticket numbers, then the person who has record of the earliest ticket purchase shall be deemed to hold the winning entry.


AWARD OF PRIZE(S) TO OFFICIAL WINNER


A prize will be awarded to the Official Winner who has been designated by Sponsor. All prizes need to be picked up by the Official Winner at the time the Official Winner delivers the winning raffle ticket to Sponsor or an authorized representative of Sponsor.


TAXES


The taxable value of the prize will be treated as ordinary income to the Official Winner for federal and state income tax purposes, and each Official Winner will be required by law to pay the tax liability incurred in connection with his/her receipt of the prize.


Nothing contained in this section shall be construed such that either Sponsor, or its charitable partners, licensors and suppliers, and each of their respective parents, affiliates, subsidiaries, partners, and advertising and promotion agencies, and all their respective officers, directors, employees, representatives, shareholders, members, consultants and agents, is in any way liable for the winner’s tax liability that is created when the Official Winner claims his or her prize(s). This provision is meant only to mitigate, not eliminate, the winner’s tax liability from winning the prize(s).


GENERAL CONDITIONS


The Released Parties (defined below under “RELEASE OF LIABILITY”) are not responsible for: (1) Entries which are stolen, lost, damaged, illegible, given away or no longer in the purchaser’s possession, (2) Entries that have been or may have been tampered with or re-sold in violation of these Official Rules; (3) Entries or payments that are delayed, misdirected, undelivered, not fully captured, or garbled as a result of any failure or problem whatsoever with the availability, functionality, operability or use of any network, server, ISP, website, computer, telephone, cable or satellite modem or connection, hand-held mobile device or any other computer equipment or connection, whether or not caused by site users, tampering, hacking, or by viruses, worms, or malfunctions affecting a network, server, ISP or any equipment or programming used in or associated with the raffle; (4) any other errors of any kind, whether human, typographical, printing, mechanical, or electronic in nature, which relate to or are connected with the raffle (collectively, as described in clauses (1) through (4), “Errors”), including without limitation Errors in raffle-related materials or in the administration of the raffle, such as Errors in processing entries, identifying winners, determining Official Winners, or announcing or delivering prizes; or if any portion of the raffle is compromised, in Sponsor’s sole judgment, by a virus, worm, bug, non-authorized human intervention or other causes which, in Sponsor’s sole judgment, corrupt or impair the administration, security, fairness or proper play of the raffle, or the proper submission or capture of entries (collectively, a “Compromising Event”), then Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the raffle, and to select winners from all eligible, non-suspect entries received before the known occurrence or discovery of such Comprising Event, but in no event is the Sponsor required to do so and may, in its sole discretion, cancel the raffle and not select a winner from the eligible, non-suspect entries received prior to the occurrence or discovery of the Compromising Event. Unless a raffle is cancelled completely and no drawing for a winner is held, all entry purchases shall be final, and no refunds or replacements will be issued by Sponsor. Sponsor has sole and final decision on admissibility of entries and the determination of the prize winner.


RELEASE OF LIABILITY


By participating in the raffle and purchasing raffle tickets through this website, entrants agree that Sponsor and its charitable partners, licensors and suppliers, and each of their respective parents, affiliates, subsidiaries, partners, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, shareholders, members, consultants and agents (collectively, the “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for injuries, losses, costs, expenses or damages of any kind, including damages for death, personal injury, property damage or property loss, or other harm resulting from, whether in whole or in part, directly or indirectly, participation in this raffle or the acceptance, possession, use or misuse of any entry, the use or misuse of any prize or prizes, rules and their application thereof, all means of ticket sales, raffle process, and/or winning ticket selection.


PUBLICITY RELEASE


Each Official Winner, by accepting his/her prize, grants Sponsor and Sponsor’s designees and affiliates, including its charitable partners, licensors and suppliers, and each of their respective advertisers, sponsors and other entities, full permission, except where legally prohibited, to use that Official Winner’s name, address (city and state only), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide, and on the internet and world wide web, in perpetuity.


COPYRIGHT


All raffle materials are copyrighted by Sponsor, and may not be copied, reproduced or used for any purpose without Sponsor’s express prior written consent.


HEADINGS


The subject headings of the sections of these Official Rules are included for convenience and reference only and shall not affect the construction or interpretation of any of the terms and conditions of these Official Rules.


GOVERNING LAW; SEVERABILITY


The raffle and these Official Rules shall be subject to and governed by the laws of the State of Massachusetts. Anyone purchasing raffles tickets hereby agrees and confirms that each party’s obligations, pursuant to these Official Rules, have been performed and will be fulfilled and discharged within the jurisdiction of the State of Massachusetts. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law. DEPOSITING RAFFLE TICKETS OR RELATED MATERIALS IN THE FEDERAL MAILS IS A VIOLATION OF FEDERAL LAW AND COULD LEAD TO CRIMINAL PENALTIES. ALL RAFFLES ARE VOID WHERE PROHIBITED BY LAW.
